How can I get the closed captioning to REMAIN at the bottom of the screen and not randomly show across character faces nor the top of the screen. is this an issue with U-verse software or how networks broadcast?

I have had uverse for a year and half and it goes out every night at 1am. I am not able to watch tv past 1am. I have had new equipment twice and my house and yard rewired. No one at At&t can answer what is causing this.
